Terms and Conditions

Bookings & Payments – The Contract for a short-term holiday rental will be between Dam View and the person making the booking and all members of the holiday party. In the following booking conditions. The contract will be subject to these booking conditions and must be complied with.

Dam View only accepts bookings from persons over 25 years of age. Dam View reserves the right, always, without statement of reasons, to refuse or cancel a booking, if we feel it would be detrimental to other guests (for example an all adult group booking to stay when the rest of the site is full of couples and families).

All bookings via our online system should be treated as provisional until you receive confirmation from us via email. To secure your booking a deposit of 30% (or full payment) of the cost of your stay is required.

Bookings must be paid in full no later than 6 weeks prior to the date of your stay, remainders for balance payments will be sent out via email prior to payment being due. Failure to make payment of the full balance within 48 hours of the due date will result in the cancellation of your booking and no refund will be due. If the booking is made less than 6 weeks from the date of your stay the full price of the stay is required. Confirmation of the booking will be sent after the deposit, or full payment, has been received via email.

When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form. This does not form a contract between us. A contract shall only arise when your booking is subsequently confirmed in writing via a letter of confirmation sent to you by email.

The prices featured on the website are not binding; Dam View reserves the right to modify these prices. At the time of booking, you will be informed of the prices applicable. The price stated on the confirmation invoice is binding.

 

Arrival & Departure Times – We ask that you arrive on your specified arrival date after 4.30 and before nightfall; we do understand that sometimes this may be inconvenient, or events occur to make this difficult. It is very important to plan your journey so that you arrive at Dam View during the daylight. Arriving and settling into your lodge is an adventure; from arriving at the farm entrance, navigating the track to the parking area, to unloading your luggage and wheel barrowing everything down the field, it’s all part of the experience. However, it is unlike arriving at a hotel where you park up and walk across a well-lit path, so please do plan to arrive during daylight

hours, it really is essential. It will take time to load & unload and then unpack and light the wood burning stove also. All of this is so much easier in the daylight as it really is pitch black once the sun goes down.

Guests are requested to vacate their lodge by 10.30am on the date of their departure. Our cleaning staff will require access to your lodge from 10:30am.

 

Cancellation Policy (Non Covid19)

Cancellation by Dam View – In the event that we need to cancel your holiday we shall inform you as soon as possible and refund all monies paid to us, by you, within 14 days.

 

Cancellation by you the Guest – We realise that sometimes plans change and if you have to cancel your holiday please let us know as soon as possible and we will try to work with you to find the best solution.In all cases we will endeavour to re-let your accommodation. If you cancel with more than 6 weeks until your stay, when just the Deposit has been paid, and we are successful in re-letting your lodge, then we will refund your monies paid to us less an administration fee of £50 to cover re-advertising costs and our time. If we are unable to re-let the accommodation, we will retain the one third of deposit paid.

If the holiday is within 6 weeks, when the full balance is paid, if we are unable to re-let the lodge, we will retain the full payment.If we are successful at re-letting the lodge, then we will refund your monies paid to us less an administration fee of £50 to cover re-advertising costs and our time.

 

Guest inability (or the inability of any, some or all your intended party) or disinclination to travel to and stay at Dam View for any reason.
This includes – but is not limited to – all illnesses (including Covid19), a requirement or recommendation to self-isolate or quarantine or are shielding. A call to jury duty, military service, incarceration, change in personal or work circumstances, family emergencies, travel delays, vehicle breakdown, and delays with public transport. These remain at Your risk and do not give rise to a right to cancel or to receive a refund unless we are able to re-let your lodge, where you will receive a full refund of monies paid less an administration fee of £50. This is to cover our costs for re-advertising your stay and to cover our time.

Cancellations must be notified to Dam View via email. Once received in writing we will confirm the cancellation request.

We strongly recommended you take out appropriate Travel Insurance to cover eventualities. If you choose not to take out appropriate Travel Insurance, then you accept responsibility for any loss that you may incur due to your cancellation.

 

Covid19 Cancellations

National Lockdown Covid-19 – In the event that Dam View is not able to open due to either the government imposing a national or local lockdown in our county of Clackmannanshire preventing us to open then the following options will be available to you:

  1. Reschedule your stay to another time. If the stay that you reschedule to is more expensive than your current stay, all we ask is that the difference in the cost of the stay is paid.
  2. Request a refund. We understand that sometimes guests are not able to reschedule their stay to another time and therefor would prefer to have a refund. For this option there is a small deduction from the amount of either your deposit or the full balance if you have paid in full paid of 5%, this is to cover our costs when processing both the booking & refund.

 

Regional / Local Lockdown Covid-19 – In the event that the government imposes a regional / local lockdown for your given address, preventing you from travelling to Dam View for the dates of your stay then the following options will be available to you:

  1. Reschedule your stay to another time. If the stay that you reschedule to is more expensive than your current stay, all we ask is that the difference in the cost of the stay is paid.
  2. Request a refund. We understand that sometimes guests are not able to reschedule their stay to another time and therefor would prefer to have a refund. For this option there is a small deduction from the amount of either your deposit or the full balance if you have paid in full paid of 5%, this is to cover our costs when processing both the booking & refund.

In the event of you needing to cancel your holiday due to having to self isolate or if any of your party have caught Covid, then our existing Cancellations and Refunds policy will be in force.

We strongly recommended you take out appropriate Travel Insurance to cover these eventualities. If you choose not to take out appropriate Travel Insurance, then you accept responsibility for any loss that you may incur due to your cancellation.

It is the responsibility of the guest to acquire suitable travel insurance for themselves and their party to cover their booking. Dam View strongly recommends that the guest acquires suitable insurance to cover circumstances beyond the guests control such as, but not limited to, jury duty, incarceration, change in personal or work circumstances, military service, illness – including Covid19 and shielding, family emergencies and travel delays.

Covid19 is now a known risk and it is possible for you to insure your holiday against it, lead guest or any other member of the party having Covid19, the lead guest or any member of the party having to isolate or quarantine, or you wishing to shield any members of the party and enforced localised restrictions.

There are several options which include cover for Covid19 related cancellations available from organisations such as:

In no way do we endorse any of these organisations and it is the responsibility of the guest to satisfy themselves that the level of cover offered is sufficient and appropriate.

 

Pets Are Not Permitted to Stay – Due to the level of wildlife her at Dam View and livestock in the fields surrounding our site, we regret that pets are not permitted to stay. As much as we appreciate that people love their pets, please do not be tempted to smuggle them in as you will be asked to leave and forfeit all monies paid.

 

Stag & Hen Parties – We do not permit Stag Parties at Dam View. We allow small Hen parties, please email or call to discuss your requirements.

 

Day visitors – Please contact us in advance of having guests and please do not exceed the limit on the lodges if they plan to stay. Respect the other guests that are staying.

 

Guest Behaviour – The holiday; guest conditions of occupancy and conduct
The Guests have the right to occupy the Property for the paid for holiday period only (within the meaning of Schedule 1)

 

Paragraph 9 of the Housing Act 1988).

Guests undertake to behave in a proper, appropriate, and legal manner with due respect to the Owner, the Property and other guests and their property. If any guest behaves inappropriately or improperly (of which the Owner will be the final judge on their Property), or illegally, the Owner reserves the right to ask the guest and their party (at their discretion) to leave the Property before the end of the holiday period. Any refund for so doing will be at the entire discretion of the Owner. In addition, the Owner reserves the right to sue the guest for any loss, damage or injury caused to the Owner, the Property or to other guests and/or their property.

 

Noise – We really want all our guests to enjoy a peaceful relaxing stay with us. Therefore, to keep the woodland peaceful and so as not to disturb the other guests staying / wildlife and our neighbours, we kindly ask that guests keep noise to a minimum from 9:00pm onwards and after 10.00pm the only sounds that should be heard are those of quiet whisperings from our guests and the sounds of the wildlife that call Dam View/Gartmorn Dam their home. We are a predominantly family site and there may well be young children sleeping. You are staying in a canvas lodge, and noise will carry.

We do not allow any music or radios at any time as noise is amplified and it travels very easily between canvas lodges.

We also ask guests to be conscious of how much noise your party are making around the fire pits at night. We promise we aren’t the ‘Party Police’; we want ALL of our guests to enjoy a stay at Dam View, but if you are looking for a venue to come and play music and be up late into the night enjoying karaoke around the fire pit or in a wood-fired hot tub, then we aren’t the site for you.

We have 4 x children ourselves and appreciate that they tend to be early risers! If parents of young children can try to let the adults sleep in in the morning, without unleashing the children to the great outdoors until after 8am it would be greatly appreciated!

In exceptional circumstances we reserve the right to ask you and your party to leave if there is repeated noise after having received two warnings and as you will have breached the terms of your contract with us, no refunds will be forthcoming.

 

Smoking – Dam View is a non-smoking site. Therefore, smoking is not permitted at any time within our lodges & field. If it is evident that guests have been smoking in the lodge then the security will not be refunded to compensate for the additional cleaning and delay in being able to re-let the lodge.

 

Wood-fired Hot Tubs – A wood-fired hot tub is a wonderful addition to your stay and at Dam View, if you have booked a wood-fired hot tub during your stay, then you will need to read through all the information on the Guest App and the information in your lodge regarding how to use them properly, their safe operation and will have to adhere to the safety rules. Failure to do so could result in an additional cleaning fee of £25.

Most guests use the hot tubs responsibly but in exceptional circumstances we reserve the right to close a hot tub if we believe the guidelines are not being followed or guest behaviour could cause damage to themselves or the hot tub or there is excessive noise at night.

 

Littering – We are committed to protecting our space and the wildlife within. We respectfully ask our guests to do the same and use the numerous bins provided. If you drop it, we have to pick it up!

 

Damage – Should any facilities, equipment, or inventory, be damaged wilfully, as a result of inappropriate usage or behaviour, or a as a direct result of failing to respond to instructions from Company staff you will be held responsible for the cost of repair or replacement of that item. The company cannot accept responsibility from any loss, damage, or expense arising from industrial action, terrorist activity, adverse weather conditions or any other event outside the control of the company.

 

Additional Cleaning – All cleaning under normal circumstances is included in the cost of your stay. If additional cleaning of the lodge is required, including washing up, additional cleaning of the interior or fixtures and fittings then Dam View reserves the right to charge for this work at a rate of £13 per hour. Dam View reserve the right to deduct this payment from your security deposit or invoice guests following their stay.

 

Additional Guests – Over Capacity – If you arrive with more guests than you have booked for or more than the maximum capacity of the lodge which is 6, we reserve the right to cancel your booking, no refunds will be forthcoming.

 

Right of Entry – We shall be allowed the right of entry to the lodges at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.

Candles, Chinese Lanterns, Fireworks & Fires – Candles are not permitted in the lodges at any time due to them being a fire hazard.
Fireworks & Chinese Lanterns are not permitted on our farm at any time. They are fire hazard not just for us and our canvas lodges but also the local farms, due to the noise from fireworks they may also cause a great deal of stress to the wildlife that calls our land their home but also to the livestock in the fields that surround Dam View – we reserve the right to ask you and your party to leave if we find you using either as you will have breached the terms of your contract with us, no refunds will be forthcoming.

Any fires outside the tents are strictly permitted to the fire pits areas only, using the equipment provided. Please do not leave any fires unattended.

 

Responsibility – By booking and coming to stay at Dam View, you agree to be responsible for your children and any children you are in charge of, and your own welfare and to take all reasonable precautions against personal injury, injury to others and damage to facilities and lodge.

Children must be supervised at all times near the ponds and ANY play equipment – Use of the facilities at Dam View, is the responsibility of the Guest and is done so at their own risk, and children must be accompanied by an adult at all times.

By its very nature Dam View is a campsite in a natural environment. In working to preserve and enhance the land and it’s biodiversity, and create a sense of freedom which is part of the charm and why many people come, there are natural hazards, such as ponds, tree roots, poisonous plants, and extremely limited lighting after dark, and depending upon weather conditions, cold, wet and slippery surfaces and even frozen water pipes.

Swimming in any of the ponds at any time is not permitted

 

Breach of Booking Conditions – If there is a breach of any of these conditions by the Guest or any of their party, the Owners reserve the right to re-enter the Property and end the holiday and ask the Guest and their party to leave in addition to their other rights specified in these Booking Conditions. Ending the Holiday by the Owners or the Guests does not affect that party’s other rights and remedies.

 

Governing Law and Jurisdiction – Any dispute will be governed by the non-exclusive law and jurisdiction of the English Courts.
Authority to Sign – the person who signs the Booking Form certifies that:

– he or she is authorised to agree the Booking Conditions on behalf of all persons included in the Booking Form, including those substituted or added at a later date;

– the signatory is over 25 years of age;

– they agree to take responsibility for the party occupying the Property, and to notify the Owners if they are not a member of the holiday party.

Nothing in these conditions excludes or limits the liability of the Owners: – for death or personal injury caused by the Owners negligence.

– for any matter which it would be illegal for the Owners to exclude or attempt to exclude their liability.

– The use of ponds, climbing trees using the trampolines or hot tubs and any other activity on the Owners land is the responsibility of the Guest and is done so at their own risk.

We strongly recommended you take out appropriate Travel Insurance to cover these eventualities. If you choose not to take out appropriate Travel Insurance, then you accept responsibility for any loss that you may incur due to your cancellation.

 

Liability – Dam View accepts no liability for theft, loss, or damage, of whatever nature, during or as a result of a stay at Dam View.

– the tenant and those who accompany him or her, are jointly and severally responsible for all loss and/or damage which arises, for Dam View and, or any third party as a direct or an indirect consequence of their stay, irrespective of whether this was caused through actions or refraining from actions by themselves or by third parties, who are at Dam View their making, as well as of all damage which is caused by matter which they have under their responsibility.

– If you leave your tent in an improper condition, additional (cleaning) costs can be charged at a cost of £13 per hour.

 

Validity clause – In the event that a court finds that a condition in these Booking Conditions is illegal or void, the illegal or void provision will be severed from the remainder of the Booking Conditions, which will continue to be valid and have full force and effect.

 

Complaints – Despite all the care of Dam View it could occur that you have a genuine complaint. You must take up this complaint with the Owner immediately, in order to allow us to solve the matter as soon as possible. Should the complaint not be settled to your satisfaction, then you have the option, up to 14 days after your departure to submit the complaint in writing or by email to Dam View .

 

GDPR – General Data Protection Regulations – All personal data collected when a booking is placed will not be passed on or sold to any 3rd party. Dam View does not contact any guests for Marketing purposes.
We do not store any bank details when a booking is placed.
